Tennessee Citizen Suing City and Fire Apparatus Driver Over Non-Emergency Driving Mishap with Fire Apparatus

The city of Franklin is being sued by a woman who was injured when her car was struck by a fire truck.





Mary Ellen Murphy, 53, is seeking more than $100,000 from the city and John E. Pratt, who was driving the fire truck that struck her car on Oct. 17, 2008.

Murphy, who was driving a 2000 Toyota Avalon, and Pratt were leaving the Alexander Plaza Shopping Center. Murphy's car was in a lane for vehicles to turn right or go straight. The fire truck came into the left-turning lane but Pratt turned right and struck the Toyota's left side, according to a police report. The fire truck was not traveling at a high rate of speed and firefighters were not responding to an emergency call.

The fire truck suffered an estimated $400 in damage, while Murphy's car suffered what was described in a police report as "severe" damage. Murphy was taken to Williamson Medical Center. Her injuries were not described in the police report or her lawsuit.

Murphy claims Pratt was "not paying proper attention to the traffic around him" and failed to maintain control of the fire truck or "proper lookout."

The city has until late November to respond to the complaint.
